The law firm of Lipsitz & Ponterio, LLC is announcing a total of $3.15 million in settlements on behalf of an Ithaca, New York man against several distributors and manufacturers of joint compound. Beginning in 1962, the plaintiff was exposed to asbestos-containing joint compound as a result of repairing walls and performing renovations in residential homes.
From 1962 to 1978, the plaintiff mixed asbestos-containing dry joint compound with water and applied the wet mixture to wallboards. Once the material dried, he sanded the joint compound which generated a great deal of dust. After sanding the joint compound, he swept the residue material off the floor which also exposed him to a great deal of dust.
In 2006, and as a result of his exposure to asbestos-containing joint compound, the plaintiff was diagnosed with malignant mesothelioma at the age of 60.
The law firm of Lipsitz & Ponterio, LLC is announcing a total of $2.58 million in settlements on behalf of a Schenectady, New York man against several distributors and manufacturers of joint compound, paint, and floor and ceiling tiles. The plaintiff was previously employed as licensed contractor who applied paint and installed drywall, flooring and ceiling tiles for Rite Aid stores throughout New York State.
Beginning in 1964, our client was exposed to asbestos fibers, dust and particles when he was exposed to joint compound and ceiling tiles when he was employed as a lather. From 1971-1979, the plaintiff was employed as a licensed contractor and would participate in converting approximately ten Rite Aid stores per year, which on average lasted one to one and one-half months per store. During the construction of these stores, the plaintiff was exposed to joint compound, paint, ceiling and floor tiles which contained asbestos. On a daily basis he applied and sanded products that contained asbestos.
As a result of exposure to asbestos-containing products, the plaintiff was diagnosed with malignant mesothelioma in 2007 at the age of 61.
The law firm of Lipsitz & Ponterio, LLC is announcing a total of $2.2 million in settlements on behalf of a Clarence, New York man against several distributors and manufacturers of joint compound, putty and caulk materials and automotive brake parts. The plaintiff performed general remodeling projects during the summers from 1974 through 1977. During the remodeling process, the plaintiff was exposed to asbestos-containing joint compound. On a daily basis he applied and sanded products that contained asbestos.
In addition, the plaintiff maintained and repaired passenger car automotive brakes. From 1978 to 1990, our client was exposed to asbestos fibers, dust and particles when he installed and replaced automotive parts that contained asbestos.
In 2006, the plaintiff was diagnosed with peritoneal mesothelioma at the age of 47. Our client is happily married, and his income was the main source of financial support for his family. The $2.2 million dollar settlement will insure the financial future of the plaintiff's two children who are minors.
